¿CUÁNTO TIEMPO TENGO PARA REVALIDAR MI LICENCIA DE CONDUCIR?

Los recientes cambios en el Reglamento Nacional del Sistema de Emisión de Licencias de Conducir traen novedades respecto al límite de renovación del brevete.

Vayamos paso a paso para aclarar las dudas.

El Reglamento Nacional de Licencias de Conducir Vehículos Automotores y No Motorizados de Transporte Terrestre se aprobó el 17 de noviembre del 2008 (DS 040-2008-MTC).

En primera instancia, esta norma establecía, en el quinto párrafo del artículo 25 (del título VI: de la revalidación y duplicado), lo siguiente:

“Las renovaciones podrán ser solicitadas dentro de los treinta (30) días calendario anteriores a la fecha de revalidación de la licencia de conducir, la misma que perderá su vigencia a los cinco (5) días calendarios a partir de la fecha de revalidación”.

Luego, el 24 de setiembre del 2015, se aprobaron algunas modificaciones a distintos reglamentos emitidos por el Ministerio de Transportes y Comunicaciones (MTC), entre ellos, el de licencias de conducir (DS 009-2015-MTC). Tras esto, la norma determinaba:

“La revalidación de la licencia de conducir se podrá solicitar a partir de los treinta (30) días calendario anteriores a la fecha de revalidación consignada en la licencia de conducir y hasta los noventa (90) días calendario posteriores a dicha fecha. La licencia de conducir perderá su vigencia al día siguiente de la fecha de revalidación sin que esta se haya realizado”.

Además, añadía: “Las personas que no revaliden su licencia de conducir en el plazo establecido en el presente artículo, deberán obtener una nueva licencia”.

De esta forma, esta nueva indicación del MTC imponía un plazo máximo de tres meses a la etapa de revalidación del brevete y obligaba, a aquellos que no renovaban durante dicho periodo, a tramitar una nueva licencia con todos los procesos que implicaba . Asimismo, eliminaba los cinco días de vigencia que mantenía el permiso luego de caducar.

Sin embargo, el pasado 23 de junio del 2016 (por Decreto Supremo 007-2016), el MTC aprobó el “Reglamento Nacional del Sistema de Emisión de Licencias de Conducir” que reemplazó al “Reglamento Nacional de Licencias de Conducir Vehículos Automotores y No Motorizados de Transporte Terrestre” emitido en el 2008.

Ahora, tras la reciente modificación de este documento (oficializada por Decreto Supremo 026-2017), la ley apunta en el artículo 19 que el brevete pierde vigencia el mismo día de su caducidad y no tiene fecha límite para su renovación.

“Artículo 19.- Revalidación de Licencias de Conducir
19.1. Las licencias de conducir son válidas hasta el último día de su vigencia. La solicitud de revalidación puede presentarse en cualquier momento durante su vigencia o después de culminada esta; sin perjuicio de ello se encuentra prohibida la conducción con una licencia vencida. La Licencia de Conducir que se expida previo procedimiento de revalidación estará vigente desde su fecha de emisión”.

¿Cuáles son las sanciones por conducir con el brevete vencido?

El nuevo Reglamento Nacional del Sistema de Emisión de Licencias de Conducir añade el código M.40 al Cuadro de Tipificación, Sanciones y Medidas Preventivas aplicables al Tránsito Terrestre del Texto Único Ordenado del Reglamento Nacional de Tránsito que establece lo siguiente:

Vigencias de las licencias de conducir por categoría

Estas son las nuevas vigencias de las licencias de conducir con los nuevos cambios en el reglamento:

Clase A – Categoría I: su vigencia es de 2 años cuando un conductor saca su licencia por primera vez. Después, la vigencia se extiende a 5 años (antes era de 8 años).
Las demás categorías tienen una vigencia de 3 años.
Todas las categorías de las licencias de clase B tienen una vigencia de 5 años.

Cabe precisar también que ahora la edad máxima para obtener una licencia de conducir es de 80 años. Por ello, en el caso de los conductores profesionales, la vigencia de su brevete será de 1 año desde los 70 hasta los 76 años y de 6 meses desde los 76 hasta los 81 años.

En el caso de conductores no profesionales, la vigencia será de 5 años desde los 70 hasta los 75 años, de 3 años desde los 75 a los 81 años, y de dos años a partir de los 81 años, según indica la norma.

“En ambos casos, al momento de emitirse las licencias de conducir, se deberá respetar los límites de edad establecidos en el presente artículo”, finaliza el artículo 20 del Reglamento Nacional del Sistema de Emisión de Licencias de Conducir.

The recent changes in the National Regulation of the System of Issuance of Driver's licenses bring news regarding the limit of renewal of the brief.

Then, on September 24, 2015, some modifications were approved to different regulations issued by the Ministry of Transport and Communications (MTC), among them, the license of drivers (DS 009-2015-MTC). After this, the rule determined:

"Revalidation of the driver's license may be requested from the thirty (30) calendar days prior to the revalidation date on the driver's license and up to ninety (90) calendar days after that date. The driver's license will lose its validity the day after the revalidation date without it has been realized ".

In addition, he added: "Persons who do not revalidate their driver's license within the period established in this article must obtain a new license."

Thus, this new indication of the MTC imposed a maximum period of three months to the revalidation stage of the brief and forced, for those who did not renew during that period, to process a new license with all the processes involved. Also, it eliminated the five days of validity that held the permit after expiration.

However, on June 23, 2016 (by Supreme Decree 007-2016), the MTC approved the "National Regulation of the System of Issuance of Driver's Licenses" that replaced the "National Regulation of Licenses to Drive Automotive and Non-Motorized Vehicles Of Terrestrial Transportation "issued in 2008.

Now, after the recent amendment of this document (formalized by Supreme Decree 026-2017), the law states in article 19 that the brief will lose its validity on the same day of its expiration and there is no deadline for its renewal.

"Section 19.- Revalidation of Driver's Licenses
19.1. Drivers' licenses are valid until the last day of their validity. The application for revalidation may be filed at any time during its validity or after its completion; Notwithstanding this is prohibited driving with a license expired. The Driver's License issued prior to the revalidation procedure shall be in force from the date of issue. "

What are the penalties for driving with the expired crash?

The new National Regulation of the System of Issuance of Driver's Licenses adds the code M.40 to the Table of Typification, Sanctions and Preventive Measures applicable to the Terrestrial Transit of the Single Text Ordered from the National Transit Regulation that establishes the following:

These are the new validities of the drivers licenses with the new changes in the regulation:

Class A - Category I: valid for 2 years when a driver takes out his license for the first time. Afterwards, the validity extends to 5 years (before it was 8 years).
All other categories have a validity of 3 years.
All categories of Class B licenses are valid for 5 years.

It should also be noted that now the maximum age for obtaining a driver's license is 80 years. Therefore, in the case of professional drivers, the duration of their brief will be 1 year from 70 to 76 years and 6 months from 76 to 81 years.

In the case of non-professional drivers, the validity will be 5 years from 70 to 75 years, from 3 years from 75 to 81 years, and from 2 years from 81 years, according to the norm.
